01. Acceptance of Terms & Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ARIA Technologies / Jameel Rashid ("ARIA", "we", "us", or "our"), governing your access to and use of ariainterface.onrender.com, ariainterface.com, the ARIA OS web application, offline browser engines, and related services.

By creating an account, clicking "Sign In", "Sign Up", or continuing to use any feature of ARIA, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our Privacy Policy. If you do not agree to all terms, you must immediately cease using the platform.

02. Educational Study Aid Status

ARIA is an independent, artificial-intelligence-powered revision platform and educational study companion designed to assist students and educators with learning, homework comprehension, and curriculum review.

Independent Developer Disclosure: ARIA was designed, engineered, and developed by Jameel Rashid. ARIA is an independent educational tool and is not officially endorsed by, affiliated with, or an accredited partner of Cambridge Assessment International Education, the Kenya National Examinations Council (KNEC), or the National Examinations Council of Tanzania (NECTA).

03. CRITICAL: AI Accuracy Disclaimer & No Warranty

• No Guarantee of Exam Results: While ARIA is engineered with curriculum marking schemes, we do not guarantee specific exam grades, test scores, or academic admissions results. You are solely responsible for cross-referencing all AI-generated solutions with official school textbooks, verified past papers, and certified teachers.
• No Professional Advice: ARIA's outputs do not constitute certified legal, medical, engineering, or financial advice. Never rely on ARIA for critical real-world health, safety, or legal decisions.
• "AS IS" Provision: The platform, including all online chat endpoints, Vision OCR solvers, and WebLLM offline engines, is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

04. Subscriptions, Billing & Strict No-Refund Policy

A. Pricing & Passes

ARIA offers optional paid subscription tiers ("ARIA Pro") and day passes (e.g. KES 75/day, KES 750/month, $5.00/month, TZS 15,000/month) payable via M-Pesa or card through PesaPal.

B. Immediate Delivery of Digital Goods & No-Refund Policy

Refunds will not be issued for:

• Unused days remaining in a billing cycle after account cancellation.
• Dissatisfaction with AI-generated answers or study outputs.
• Temporary internet connectivity interruptions on the user's end.
• User device incompatibility with optional local WebLLM models.

Exception: If you were subject to an unambiguous duplicate billing transaction caused by a technical server error, contact ariaassistantsupport@gmail.com within 72 hours of the transaction with proof of payment for review and correction.

C. Chargeback & Payment Fraud Protection

Filing an unauthorized, fraudulent, or bad-faith chargeback dispute with your bank or mobile money provider without contacting ARIA support first will result in immediate, permanent termination of your account, revocation of all generated assets, and reporting to relevant fraud registries.

05. Promotional Access & Review Incentive Rules

ARIA may from time to time run promotional campaigns (such as "Submit a Review to Receive 1 Month of ARIA Pro"):

• Authenticity Requirement: Promotional Pro access is granted solely to legitimate users who test the platform and submit a thoughtful, honest review to our designated support emails (jameeljay7@gmail.com or ariaassistantsupport@gmail.com).
• Discretionary Activation: Promotional upgrades are activated at the sole discretion of ARIA management. Automated spam, duplicate email submissions, bot accounts, or fraudulent claim attempts will be disqualified without notice.
• One Promotion Per Person: Promotional passes are strictly limited to one (1) redemption per user/household. Promotional months have zero cash value and cannot be transferred, exchanged, or refunded.

06. User Conduct & Prohibited Activities

You agree not to use ARIA for any unlawful, unethical, or harmful activities, including but not limited to:

• Academic Dishonesty Violations: Utilizing ARIA to cheat during active, live proctored school examinations where electronic devices are strictly prohibited by school or national exam regulations.
• Harmful Content: Generating hate speech, sexually explicit content, self-harm instructions, cyberbullying, or harassment against educators or students.
• Reverse Engineering & Scraping: Reverse engineering the ARIA client code, executing unauthorized automated scraping bots, or attempting to bypass token rate limits.
• System Attacks: Injecting malicious scripts, SQL/NoSQL injection payloads, or launching Denial of Service (DoS) attacks against our infrastructure.

07. Intellectual Property & User Content License

• Your Content: You retain all intellectual property rights in the original study prompts, notes, and homework documents you submit to ARIA. You grant ARIA a worldwide, non-exclusive, royalty-free license solely to transmit, process, and display this content to fulfill your requests.
• ARIA Platform Rights: The ARIA platform name, brand logos, user interface design, custom styling, client logic, and underlying software code are the exclusive intellectual property of Jameel Rashid and ARIA Technologies. You may not copy, reproduce, or resell any portion of ARIA without express written permission.

08. Peer Study Rooms & Video Chat Conduct

When participating in multiplayer Study Rooms:

• Users must maintain a respectful, educational environment. Bullying, inappropriate camera broadcasts, or sharing offensive whiteboard drawings is strictly prohibited.
• ARIA does not actively monitor private P2P video calls. You assume all responsibility for interactions with peers you invite into your study rooms via 6-digit room codes.

09. YouTube Automation & Third-Party Services

If you utilize the optional YouTube Content Automation tool:

• You are solely responsible for ensuring the video content scheduled or uploaded to your YouTube channel complies with YouTube Community Guidelines and copyright laws.
• ARIA is not liable for any account strikes, copyright flags, or monetization penalties imposed by YouTube/Google on your external accounts.

10. LIMITATION OF LIABILITY & MAXIMUM CAP

11. Indemnification

You agree to defend, indemnify, and hold harmless ARIA Technologies, Jameel Rashid, and associated team members from and against any claims, liabilities, damages, losses, costs, or legal fees arising out of your violation of these Terms, your misuse of the platform, or any content you submit.

12. Account Suspension & Termination

We reserve the right to immediately suspend, restrict, or permanently terminate your account and access to ARIA at our sole discretion, without notice or liability, for conduct that we believe violates these Terms, harms other users, or exposes ARIA to legal liability.

13. Governing Law & Binding Arbitration

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.

• Informal Resolution First: In the event of any controversy or dispute, you agree to first contact ariaassistantsupport@gmail.com to attempt an informal, good-faith negotiation for at least thirty (30) days.
• Binding Arbitration: Any unresolved dispute arising under these Terms shall be resolved exclusively through final and binding arbitration administered in Nairobi, Kenya, in the English language.

14. Severability & Inquiries

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
